1. General Information
These terms and conditions apply to the use of this website (Gardens4You.ie) and by accessing this website and/or placing an order, users (hereinafter referred to as "you" or "customer") agree to be bound by the terms and conditions of Bulbs Direct B.V. - Gardens4You (hereinafter referred to as "we"or "our ").
These terms and conditions are subject to change at any time without prior notice to you.
Despite our care and effort in actualizing and updating the Website, the content of the page might be incorrect and/or incomplete. Product pictures shown on the Website are for illustrative purpose only, variations in size colour and shape may occur due to the nature of our products. As we deal in live products, it is inevitable that the sizes and colours of our product may vary from time to time; all sizes and descriptions are approximate. Gardens4You has the right to deny customer access to the Website and/or services provided on the Website. Access to the Website can be monitored.
2. Conclusion of Agreement
The offer on the website is a non-binding invitation for the customer to place an order with us.
By clicking ‘Confirm order' and submitting the order by payment on the website, the Customer makes a binding offer for concluding a contract of purchase. Before finalising the order form, the customer has the opportunity to check if the details of the order are correct.
We store the contract's content and will send you the details of your order as well as our general terms by e-mail. You can find the terms on our website at all times. The details of your order can be viewed online in your customer login.
4. Return Policy
For all cancellation and return Issues you can contact us by e-mail: firstname.lastname@example.org; always state your order number when mailing regarding your order. Our address: Bulbs Direct B.V. - Gardens4You, Achterweg Zuid 33C, 2161 DX Lisse, The Netherlands.
Right of Withdrawal
You have the unconditional right to cancel the purchase of a good without being obliged to state any reason. We must be notified of the cancellation in writing or in another durable medium (e.g. email).
If your cancellation is received whilst the order is being processed we will endeavour to retrieve it back and arrange your refund. For a cancellation received whilst in transit, we will ask you to refuse the parcel at your door and you will be refunded once the delivered goods have been returned.
If you want to cancel at any time within the "cooling off period" of 14 working days, beginning in the day after you receive the item, please note that you will be responsible for sending the goods back to us in their original condition and for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged. You will be refunded once the delivered goods have been returned.
Exceptions to the right to cancel
For the supply of goods made to the specifications of the consumer or which by reason of the nature of the product cannot be returned and/or are liable to deteriorate or expire rapidly, such as perishable goods.
We endeavour to carefully package and protect the plants for transit. If there is something wrong with your item(s) on delivery such as, damaged in transit or hasn't survived the journey, just contact us as soon as possible describing the problem and we will happily replace the item free of charge under your guarantee. Some items are perishable and therefore no need to return dead or damaged plants; however we may ask for photos to establish the problem and for quality control purposes. Damaged disposable plastic pots are not replaceable or refundable.
If you have received an item you have not ordered, please contact us within 14 days by phone or by e-mail to inform us, we will happily send out the correct item free of charge.
If you order an item and we have run out of stock, we will not substitute it until we have contacted you first and asked you to choose a suitable replacement.
However if you order one of our complete garden collection and one of the varieties is out of stock, we reserve the right to replace it with something similar and of same value to be able to process the order and ship it ASAP. We will choose a plant that's of a comparable size and price and fits in the garden collection.
Our Guarantee does not include any plants damaged due to lack of proper horticultural care. In particular, plants will not be replaced if the plant care guidelines, enclosed with the order, have not been followed. The care instruction can be found printed on the backside of the order form with your name and address on it in the clear envelope on the front of the box.
We cannot be held responsible for items that fail to grow due to extreme weather conditions, please bear this in mind when contacting us. Always plant upon receipt or as soon as possible for best results.
If any item supplied in a dormant state (e.g. bulbs, bare root perennials) fails to flourish the next season, let us know as soon as you can and we will endeavour to replace the product at the appropriate planting time or credit or refund the purchase price.
5. Prices and Delivery Costs
The prices as given include the statutory Value Added Tax. Delivery Costs are charged separately and shown separately in the invoice. Delivery Costs may depend on the order weight and the delivery location. Current shipping prices can be viewed in the section entitled ‘Delivery Cost'. We do not deliver to any Island.
6. Payment & Security
All transactions are processed over a secure (encrypted) connection (SSL), you can check this by the fact that your browser shows a padlock on checkout. We do not store any credit card information on our system, the credit card info you enter is sent direct to the Credit Card Processer (Multisafepay or Paypal). Your account or credit card number is not known by us; it's in safe hands with the Banks! Our credentials have been verified by both Multisafepay and Paypal.
Payment can be made by Credit Card, Paypal and Bank Transfer or any method shown on our website at the time you place your order.
7. Delivery / Shipment
Products are shipped using various 3rd Party Mail and Parcel Carriers; all delivery times are based upon their delivery schedules. Gardens4You can not be held responsible for delays in delivery caused by these parties or any other 3rd Party involved. We will deliver your order to the address you specify, if this address is not accurate we can not be held responsible for loss of goods.
